TERMS & CONDITIONS

These Terms and Conditions govern use of https://zahifoods.ae and purchases from Zahi Foods. Please read them before placing an order. By submitting an order, you agree to these Terms, subject to any mandatory rights available under UAE law.

  1. Seller details

The website and Zahi Foods online store are operated by ZAHI ELEMENTS TRADING – FZCO, trade licence number 61916, issued by Dubai Integrated Economic Zones Authority. Our registered premises are at DSO-IFZA, IFZA Properties, Dubai Silicon Oasis, Dubai, United Arab Emirates. You can contact us at support@zahielements.com.

  1. Eligibility and website use

You must be legally capable of entering into a contract and provide accurate, current and complete information when placing an order. You may use the website only for lawful personal or business purchasing and must not interfere with its security, operation or content.

  1. Products and information

We sell freeze-dried whole fruits, fruit pieces, fruit powders and related products. Product descriptions, ingredients, net weights, nutrition information, allergen information and storage instructions are shown on the relevant product page or packaging.

Fruit is a natural agricultural product. Size, shape, colour, flavour, aroma, texture and appearance may vary between fruits and batches. Product photographs are illustrative, and screen settings may affect colour. These natural variations are not defects provided the product otherwise matches its description and applicable requirements.

Information on the website is general product information and is not medical or dietary advice. Check the label and, where relevant, seek professional advice if you have an allergy, intolerance, medical condition or specific dietary requirement.

  1. Orders and contract formation

The checkout page allows you to review and correct order details before submission. An order is an offer to buy the selected products. An automated acknowledgement confirms receipt but does not necessarily mean that we have accepted the order.

A contract is formed when we confirm acceptance or dispatch the order, whichever occurs first. We may reject or cancel an order before acceptance, including where a product is unavailable, information is incorrect, payment is not authorised, fraud is suspected, delivery is not reasonably possible, or an obvious pricing or description error occurred. If payment has been taken for a cancelled order, we will refund the relevant amount.

  1. Availability and order limits

Products are subject to availability. We may set reasonable quantity limits and may withdraw products from sale. If part of an order is unavailable, we will contact you or refund the unavailable item and fulfil the balance where reasonable.

  1. Prices and payment

Prices are displayed in UAE dirhams and include VAT where applicable unless the website clearly states otherwise. Delivery charges are shown separately during checkout before you submit the order. The price confirmed at checkout applies, except in the case of an obvious error that a reasonable customer should have recognised.

Payments are processed through Network International and participating financial institutions. We do not guarantee that a payment method will always be available. You authorise the payment processor to charge the amount shown at checkout and agree to comply with its applicable terms.

  1. Delivery

We currently deliver to eligible addresses within the United Arab Emirates. Standard delivery costs AED 19, including VAT, and is free where the order subtotal after discounts and before delivery charges is AED 250 or more. Any different charge or promotional threshold displayed at checkout will apply to that order.

For orders successfully received and released in our fulfilment system before 3 pm on a business day, the estimate is next-business-day delivery to regular service areas and delivery within 48 hours, calculated over working days, to remote areas. Orders received after the cut-off are processed on the following business day. These estimates are subject to the exceptions in our Shipping and Delivery Policy and are not guaranteed unless expressly stated.

Risk in the products passes to you when the order is delivered to you or a person or safe location authorised by you.

You are responsible for providing complete and accurate delivery details and for ensuring that someone can receive the order. Additional costs caused by an incorrect address, failed delivery or requested redelivery may be charged where permitted and disclosed to you.

  1. Inspection and order problems

Please inspect the parcel promptly after delivery. If an item is missing, incorrect, damaged, defective, unsafe for consumption or otherwise does not conform to the order, contact us as soon as possible and preferably within 7 days at support@zahielements.com. Include the order number, a description of the issue and, where reasonably possible, photographs of the product, batch or expiry details, and packaging. This notification period helps us investigate and does not remove any mandatory statutory right.

Keep the affected product and packaging until we advise whether they are required for inspection or disposal. Do not consume a product that appears damaged, contaminated, spoiled or unsafe.

  1. Returns refunds and replacements

Due to food safety and quality requirements, we do not accept returns of food products once they have been delivered, including unopened products. After delivery, we cannot verify how a product has been stored or handled, including exposure to heat, sunlight, humidity, contamination or other conditions that may affect its safety or quality. Returned food therefore cannot be placed back into saleable stock.

We do not provide returns, exchanges or refunds for change of mind, ordering the wrong product, personal taste preference, natural product variation, or improper storage or handling after delivery, except where applicable law requires otherwise.

This restriction does not affect your rights where a product is defective, damaged, unsafe, incorrectly supplied, materially different from its description, incomplete, or otherwise non-conforming, or where a remedy is required under applicable UAE law. After reviewing the circumstances, we will provide the remedy required by law and may, as appropriate, replace the affected product, supply a missing item, repair the issue, or refund the relevant price and any applicable delivery charge.

Approved refunds will be issued to the original payment method unless another method is agreed or legally required. Bank and payment-provider processing times are outside our control.

  1. Changes and cancellations

If you want to change or cancel an order, contact support@zahielements.com immediately. We will try to help, but an order cannot normally be changed or cancelled once picking, packing or dispatch has started. Any mandatory cancellation right remains unaffected.

  1. Storage and use

Keep products in tightly closed packaging, in a dry place at room temperature, away from direct sunlight, heat and humidity. Reseal the pouch promptly after opening and follow the label instructions. Do not leave products in unsuitable environment. Zahi is not responsible for deterioration caused by storage or handling contrary to these instructions after delivery, except to the extent liability cannot lawfully be excluded.

  1. Allergens and food safety

Always read the ingredient and allergen information on the product label before consumption. Product-page information may be updated, so the label supplied with the product is the primary reference for that batch. If the packaging seal is broken, the pack is damaged, or the product appears unsafe, do not consume it and contact us.

  1. Promotions and discount codes

Promotions and discount codes are subject to their stated period, eligibility, product and usage conditions. Unless stated otherwise, codes cannot be combined, exchanged for cash or applied retrospectively. We may refuse or cancel misuse, fraud or an obvious promotional error.

  1. Intellectual property

The website and its text, graphics, photographs, product names, logos, design and other content are owned by or licensed to us and are protected by applicable intellectual-property laws. You may view and use the website for personal, non-commercial shopping. You may not copy, republish, distribute, modify or commercially exploit website content without prior written permission.

  1. Website availability and external links

We aim to keep the website accurate and available but may update, suspend or withdraw features without notice. We are not responsible for third-party websites linked from our site. Nothing in these Terms excludes responsibility for information or obligations that cannot lawfully be excluded.

  1. Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, or limits mandatory consumer rights. Subject to that qualification, we are not responsible for losses caused by your failure to follow product instructions, improper post-delivery storage or handling, unauthorised use of the website, or events outside our reasonable control.

Where legally permitted, we are not liable for indirect or consequential loss, loss of profit, business interruption or loss of data arising from a consumer purchase. For business customers, any additional limitations agreed in a separate written contract prevail for that transaction.

  1. Events outside our control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, transport disruption, governmental action, supply interruption, system outage or failure of essential third-party networks. We will take reasonable steps to minimise the impact and inform affected customers where appropriate.

  1. Privacy

Our Privacy Policy explains how we handle personal data. The cookie controls presented on the website form part of that information.

  1. Changes to these Terms

We may update these Terms for future website use and orders. The version applying to an order is the version available when the order is submitted, unless a change is required by law. The effective date at the top identifies the current version.

  1. Governing law and disputes

These Terms and purchases made through the website are governed by the applicable federal laws of the United Arab Emirates and the laws applicable in the Emirate of Dubai. The courts of Dubai have jurisdiction, subject to any mandatory consumer right to use another competent authority or forum.

Please contact support@zahielements.com first so that we can try to resolve any complaint promptly. You may also use any complaint mechanism made available by the competent UAE or Dubai consumer-protection authority.
